Federal Judge Susan Bolton agreed with Governor Jan Brewer, that Tucson police officer Martin Escobar does not have the legal standing to challenge SB 1070 in court. In her 9-page ruling, Judge Bolton wrote that officer Escobar’s claim the enforcing the law would infringe on the rights of Latinos does not give him legal standing. Additionally, Officer Escobar’s claim that learning the legal ins and outs of 1070 would take up, “his scarce time” did not sway the judge. She questioned how a police officer learning about a new law would give legal standing to have a statute overturned. Judge Bolton also order the City of Tucson to show within 14 days why its challenge of SB 1070 should not be thrown out.
