AG Kris Mayes appeals energy agreement between TEP and Project Blue developers

AG Kris Mayes 1-13

Arizona Attorney General Kris Mayes listens to a speaker at a town hall in Tucson, on Tuesday, Jan. 13, 2026, at the YWCA of Southern Arizona. Mayes heard from Tucson residents and TEP customers about what they thought about the utility company's rate increase proposal.

Arizona Attorney General Kris Mayes is appealing a decision by state utility regulators that blocked her legal challenge of the energy supply agreement for a proposed data center.

Mayes argues that the agreement allows Tucson Electric Power and Beale Infrastructure - the developers of Project Blue - to set electricity rate schedules out of public view.

The Arizona Corporation Commission approved the agreement in December.

Mayes has argued a lack of transparency around the deal, pointing to a redacted section within the agreement.

The Commission also denied Mayes’ request for a rehearing – which is why she is asking the court to undo the Commission’s decision and send it back with instructions to remove the redacted provision.
